We would like to preliminarily assure you that our customer care is our first interest. Each of our activities are carried out in the interest of our customer and have the main objective of obtaining the highest possible level of customer satisfaction. The site with the express inclusion of any existing third level domains is subject to Italian law and regulated by it. Toscanalovers is an official reseller of all the products and all the brands that are offered for sale on this site, it sells exclusively high-quality products

-DEFINITIONS

To allow for complete understanding and acceptance of the following terms and conditions, the following terms in singular and plural will have the meaning indicated below.

Owner: FATTORIA DEL CASATO SRL

Products: the products supplied to the user by the owner

User: any person who accesses and uses the app

Consumer user: the adult person who purchases

Conditions or conditions of use: this contract governs the relationships between the owner and users and the sale or supply of the products offered by the owner through the site.

The following document reports the general terms and conditions on the basis of which users are offered the use of the site which offers handcrafted products made in Italy, such as ceramics, fabrics and resin table furniture. Access and use of the site are activities regulated by the following conditions of use, as well as the purchase of any product and/or service, are activities that presuppose reading, knowledge and acceptance of these conditions, and in particular the following pages published on this site: secure payments, shipping, returns and privacy.

Use of the site implies acceptance of the conditions by the user.

 

In particular, the customer, by sending an order through this site, expressly authorizes and without any reservation, pursuant to article 13 of Legislative Decree no. 196/2003 and subsequent amendments pursuant to Legislative Decree 24/2023 for administrative and commercial uses, and accepts the conditions listed, for the processing of their personal data, on the specific page called “Privacy policy”. Therefore, anyone who accesses and/or uses services on the site expressly agrees with the owner that the site and the following conditions are governed by Italian law. The territorial jurisdiction will be that provided for by the Consumer Code, i.e. the place of residence or domicile of the consumer, if located in Italian territory. The owner takes every useful precaution in order to assure its customers that the contents of the site are accurate and do not contain incorrect or outdated information compared to the date of their publication, however it does not assume any responsibility towards users regarding the correctness, completeness and updating of any content published on the site.

Furthermore, the owner cannot guarantee its users that the site operates continuously, without interruptions and without errors or malfunctions. Also, it declines all responsibility for any problems, damages or risks that the user may encounter when using the site to the use of the Internet, outside of one’s control. The owner will not be responsible for damages, losses and costs suffered by the user following failure to execute the contract for reasons not attributable to him, the user having the right only to a possible full refund of the price paid. The owner assumes no responsibility for any fraudulent or illicit use that may be made by third parties of credit cards and other means of payment, as it does not come into contact in any way with the payment data used (number of the credit cards, owner’s name, password, etc.) The owner will not be responsible for incorrect or unsuitable use of the site by users or third parties or the issue of the product to an incorrect address or recipient, the user being the solely responsible for correct insertion

If the owner deems it necessary or even simply appropriate, at any time at his sole discretion, he may rectify, update these conditions in whole or in part, without giving any notice. The user is obliged to comply with the terms set out in these conditions, and is required to periodically check this page to verify any changes to the conditions, which will immediately become binding on the user as soon as they are published on the site. The owner reserves the right to modify, at any time, the price of the products and any price changes will in no case prejudice the contracts already concluded before the modification.

The user undertakes to verify the correctness of the data reported in the order confirmation and to immediately communicate any errors to the owner and will keep a copy of his/her order, the related confirmation and the conditions. The user undertakes to pay the price of the product in the times and ways indicated on the site and to communicate all the necessary data requested. Upon receipt of the product, the User is required to verify compliance with the order placed as well as the integrity of the packaging, and to keep the purchase document that accompanies the item. In the event that there is evident damage to the packaging and/or the product, the user can refuse delivery of the product and can return it directly to the sending courier without any cost to him. Once the delivery document has been signed, the user will not be able to make any objection regarding the external characteristics of the delivered products. The owner will not be liable to any party or third party for damages, losses and costs suffered as a result of failure to perform the contract due to force majeure. The products will be delivered to the address indicated by the user, in the manner and within the deadline indicated on the site. Delivery terms indicate the period of time usually necessary to deliver the product from the moment the courier takes charge. In the event that it is not possible to supply the requested products, your order will not be accepted with relevant notice.

 

Order confirmation

The receipt by Fattoria del Casato Srl / toscanalovers.it of the order, transmitted by the customer via electronic means, constitutes a contractual proposal from the Customer. Acceptance of the contractual proposal will take place with the transmission by Fattoria del Casato Srl / toscanalovers.it of the email confirming the shipment of the order. If Fattoria del Casato Srl / toscanalovers.it does not receive acceptance within 15 working days, the contractual proposal must be considered rejected.

 

 

 

 

Right of withdrawal

Pursuant to art. 52 of Legislative Decree 206/2005 (Consumer Code) as amended by Legislative Decree no. 21/2014, the user has the right to withdraw from the contract, without specifying the reasons, within 14 days. The withdrawal period expires 14 days after the day on which the user or a third party designated by the user, other than the carrier, acquires physical possession of the goods. To exercise the right of withdrawal, the user is required to inform Fattoria del Casato Srl / toscanalovers.it of his decision to withdraw from this contract via an explicit declaration (letter sent by post, certified email or e-mail) to the address shopping@toscanalovers.it or toscanalovers@pec.it. To comply with the withdrawal deadline, it is sufficient for the user to send the communication relating to the exercising of the right of withdrawal before the expiry of the period. If the user decides to withdraw from this contract, he will only bear the direct cost of returning the product and will be refunded all payments made for that specific product, without undue delay and in any case no later than 14 days from the day on which Fattoria del Casato Srl/ toscanalovers.it is informed of the decision to withdraw from the contract. Refunds will be made in the event of a correctly exercised withdrawal and in the event that all the items contained in the order are returned.

 

This refund will take place using the same payment method used by the user for the initial transaction. The refund may be suspended until receipt of the goods or until the user demonstrates that he has sent the goods back, whichever is earlier. Furthermore, the user must send the goods to: Toscana Lovers via delle Terme, 33 53100 Siena (Italy) with the exact same methods mentioned above, any other place other than the one mentioned above will not be accepted and returned to the sender (this will entail the having to start the entire withdrawal procedure all over again but always within the 14 days mentioned above). The owner will not accept the return if the product is damaged or used, in which case the owner will return the purchased product to the sender, charging the shipping costs to the sender. The user is responsible for the decrease in value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.

RETURN METHOD

It is possible to return one or more items, without ever having used them, within 14 days of the delivery date (including holidays) and receive a refund equal to the price of the returned products. After this deadline, the return procedure will no longer be available except as provided for in article 133 of Legislative Decree 206/2005 (consumer code).

The products must be returned intact and in the same conditions as when they were sent.

BEFORE RETURNING

One user must verify

• that each product to be returned is in the same condition in which it was originally shipped and that it is packaged carefully and in an orderly manner;
• that they are still in possession of the document certifying the purchase located inside the package.
• that all original labels are perfectly intact and have not been removed from the product
• that the returned product has not been opened or used

IMPORTANT: If the conditions listed above are not respected, the return will not be accepted

 

REFUND TERMS

Once the conditions of the returned item have been verified, the refund of the amount due will take place through the same payment method used during the purchase phase, excluding the initial shipping costs.

The refund will take place between 5 and 10 days. Processing times may vary depending on the payment method and bank.

If the order was paid by cash on delivery, the refund will be made via bank transfer within 10 days of receiving the bank details

As an alternative to the refund, it is possible to receive a voucher to spend within 6 months from the date of issue.

Please remember that in the event of a partial return of an order in which a minimum expenditure was required and a value discount code was applied (e.g. €20 discount), if the residual value of the order, following the return, was lower than the minimum amount required, the discount applied will be deducted from the refund.

All shipments are insured against damage or loss.

-POSSIBLE DELAYS

In rare cases, it is possible that the shipment of the order may be subject to some delays due to the management of the payment by the circuits or banks. Orders are delivered to the courier for shipping in chronological order, based on the times of receipt of payment.

Orders received Monday through Friday are processed within 96 hours of the order being placed. Couriers do not ship on Saturdays, Sundays and other public holidays. Furthermore, in the following periods of the year, order processing times may be delayed by up to 6/7 days:

PACKAGE TAMPERING

If the package has been tampered with, it is possible to accept the package “with reserve”. In this case the user must inform Toscana Lovers as soon as possible who will report the incident to the relevant courier.

 

DELIVERY FAILURE

In the event that the order is not delivered because the address or telephone number is incorrect or absent, the package may be returned to Toscana Lovers at the user’s expense, including any costs that Toscana Lovers must incur for the return of the goods. By purchasing on toscanalovers.it, the information (credit card number, expiration date, security code and other personal data) will be managed directly by the bank in charge of the payment transaction via an encrypted protocol, to guarantee maximum security. Toscanalovers or other subjects will never be able to access it.

Every payment made by credit card is verified through a security system to guarantee the card holder, the bank may deny authorization to proceed, forcing us to cancel the transaction and cancel the order.

In some cases, if conditions allow, the system may send a link to make payment via an alternative method. For all these cases you will always receive communication via email and we are always at your disposal for any clarification or support.
